Tim Maledy

My Approach

I am a senior litigator providing clients with skilled experience in personal injury claims against ICBC, insurance, construction, estate, and commercial litigation matters. I have successfully conducted many trials, prosecuted and defended appeals, and prevailed as counsel before the Supreme Court of Canada.

I have experience litigating cases involving catastrophic injuries, significant wage loss and business or economic loss issues, engineering and technical disciplines including geotechnical, civil and electrical engineering, fire causation, metallurgical failure, and products liability. I have also litigated significant subrogation actions arising from construction matters and otherwise on behalf of my clients.

Professional Background

Graduated from the University of Winnipeg with a Bachelor of Arts (B.A.), in Economics in 1971 and received his Bachelor of Laws (LL.B.) in 1974 from Robson Hall Faculty of Law, University of Manitoba. Tim founded and practiced at a Vancouver firm for twenty five years before joining Lawyers West LLP at its inception.

Litigation Experience

Tim has regularly appeared as counsel at the British Columbia Supreme Court and Court of Appeal. He has also appeared in the Federal Court of Canada Appeal Division and at the Supreme Court of Canada (see: Gibney v. Gilliland, [1994] 1 S.C.R. 157 on occupier’s liability, negligence, and causation issues in a catastrophic injury case).

Tim has experience with catastrophic bodily injury claims (brain injury, paraplegia, chronic pain), motor vehicle claims against ICBC, commercial litigation, estate matters, subrogation claims, and a variety of complex or multi-party litigation matters involving insurance matters, geotechnical, civil and electrical engineering issues, fire causation, metallurgical failure, products liability, leaky condo and deficient construction, and toxic waste.

Tim is proficient at analyzing liability, damage, and financial issues, utilizing expert opinion effectively, and discrediting experts and theories through persuasive argument for settlement or through effective cross-examination at trial.

Professional Activities

During his career, Tim has served on executives and committees of several societies and professional organizations including committee work for The Law Society of British Columbia. Tim is a member of the Canadian Bar Association sections for Insurance, Construction, and Civil Litigation, and former member of the BC Insolvency Association, Bankruptcy Panel of the Law Society.

Tim has presented on a wide variety of legal topics and issues to insurance groups, societies and associations, for Continuing Legal Education, and for the Canadian Institute Conference on Proactively Managing Construction Risks & Liability.
